    In this monthly roundup, legal disputes are once again cutting across every corner of the beauty and luxury industries, from trademarks and packaging to product claims, privacy and long-running talc litigation. As brands embrace new technologies and increasingly aggressive marketing strategies, protecting intellectual property while managing regulatory and litigation risk is becoming an ever more important part of doing business.

    Brand protection remains high on the agenda. Louis Vuitton secured a trademark victory in China, reigniting debate over the extent to which luxury brands should be able to protect distinctive brand assets in one of the world’s most important luxury markets. Lush also successfully blocked the ‘LushVibe’ trademark, demonstrating the lengths established brands are prepared to go to prevent names that could potentially create confusion or dilute their identity.

    Product marketing is another growing source of litigation. Lemme is facing a new class-action lawsuit over claims surrounding the marketing of its GLP-1 supplement, highlighting the legal risks emerging as beauty and wellness brands move into fast-growing categories associated with weight management and metabolic health. As consumer interest accelerates, companies operating in this space can expect increasingly close scrutiny of the evidence behind their claims.

    Few legal issues have proved as persistent for the consumer goods industry as talc. Johnson & Johnson has proposed a comprehensive settlement aimed at resolving ovarian talc litigation, as the company continues its efforts to bring years of legal uncertainty to an end. At the same time, a Scottish court approved group legal action against Johnson & Johnson over talcum powder, demonstrating the international reach and continuing complexity of the litigation.

    Restructuring proceedings are also moving forward. QVC Group secured court approval for its restructuring ahead of a planned bankruptcy exit, marking an important milestone as the business seeks to emerge with a more sustainable financial structure. The case illustrates how court-supervised restructuring is increasingly being used to reset businesses facing significant financial pressure.

    Intellectual property disputes are extending beyond trademarks. Amorepacific resolved litigation concerning the packaging of its Laneige Lip Sleeping Mask, underlining the commercial importance of distinctive packaging in highly competitive beauty categories. As products become instantly recognisable through social media and digital retail, packaging itself is increasingly becoming an asset that companies are prepared to defend.

    Technology is creating a new generation of legal risks. MAC Cosmetics is facing a biometric privacy lawsuit concerning its virtual try-on technology, highlighting the questions surrounding the collection and processing of consumer data as beauty companies introduce increasingly sophisticated digital experiences. AI, augmented reality and personalisation may offer significant commercial opportunities, but they also bring privacy and compliance responsibilities that brands cannot afford to overlook.

    Legal disputes are also reaching the highest levels of the luxury industry. LVMH is contesting claims connected to the dispute over an Hermès heir’s shares, adding another chapter to a complex battle involving one of luxury’s most valuable companies. Separately, LVMH Chairman and CEO Bernard Arnault was ordered to pay €22.5 million in a French tax dispute, demonstrating that legal and financial scrutiny extends from corporate structures to the individuals leading the world’s largest luxury groups.

    Taken together, this monthly roundup illustrates how the industry’s legal exposure is expanding alongside its commercial ambitions. Intellectual property, marketing claims, consumer safety, privacy and corporate disputes are all creating new challenges, while legacy litigation continues to demand significant attention. As beauty and luxury businesses become more technologically advanced and globally interconnected, legal strategy is increasingly becoming an essential component of brand protection and long-term value creation.
