THE WHAT? Amorepacific’s US subsidiary has secured the dismissal of a consumer lawsuit relating to the packaging of its Laneige Lip Sleeping Mask after the plaintiff voluntarily withdrew the case.
THE DETAILS The lawsuit, filed in the Superior Court of Los Angeles County, alleged that the packaging of the 0.70-ounce Laneige Lip Sleeping Mask misled consumers by making the product appear to contain more than it actually did due to opaque packaging and unused space within the container. The plaintiff claimed the packaging constituted excessive “slack-fill” and sought damages under California consumer protection laws. On 25 June, the plaintiff voluntarily requested dismissal of the case, which the court granted with prejudice, preventing the claims from being refiled. The court did not rule on the merits of the allegations or determine whether the packaging violated any laws.
THE WHY? The dismissal brings an end to the legal dispute without a judicial ruling on the packaging claims. The case nevertheless highlights the continued scrutiny beauty brands face over packaging practices, transparency and consumer perception, particularly in the US market.
