THE WHAT? Amway has filed a trademark infringement lawsuit against Florida-based Bregener Store and its alleged operator over the unauthorised sale of Amway-branded products through Amazon.
THE DETAILS The lawsuit, filed in US District Court, alleges that Bregener Store sold high volumes of products bearing Amway trademarks that were materially different from genuine products because they had not been subject to the company’s quality control and customer service requirements. Amway sells directly to US consumers through its website and authorised distributors and argues that third-party marketplace sales can expose consumers to damaged, tampered, expired or improperly packaged products. The company claims it sent Bregener Store a cease-and-desist letter in 2025 and subsequent notices but that sales continued. Amway is seeking a permanent injunction preventing the seller from offering the products, alongside other relief.
THE WHY? The case highlights the challenges cosmetics and personal care companies face in controlling unauthorised distribution on online marketplaces, where product quality, traceability and customer experience can create both consumer safety concerns and reputational risks for brand owners.
